This Acceptable Use Policy ("AUP") governs your use of RepHubCRM's services and is incorporated by reference into our Terms of Service. By using our platform, you agree to comply with this policy. Violations may result in warning, suspension, or termination of your account.
RepHubCRM is a Business-to-Business (B2B) service available exclusively to U.S. businesses for B2B outreach. Consumer marketing (B2C) is prohibited.
2. Permitted Use
You may use RepHubCRM to:
- Conduct legitimate B2B sales outreach to businesses in the United States
- Generate and send compliant commercial emails to business contacts
- Schedule appointments with business prospects
- Manage your B2B sales pipeline and leads
- Analyze campaign performance and optimize outreach
3. Prohibited Activities
You may NOT use RepHubCRM to:
3.1 Consumer Marketing (B2C)
- Send emails to consumers for personal, family, or household purposes
- Market consumer products or services to individuals
- Contact individuals at personal email addresses for non-business purposes
- Use consumer email lists or databases
3.2 Spam and Unsolicited Communications
- Send unsolicited bulk emails that violate the CAN-SPAM Act
- Use purchased, rented, or scraped email lists without proper business relationship or consent
- Send communications to recipients who have opted out
- Use automated tools to harvest email addresses
- Exceed reasonable sending volumes that may harm deliverability
3.3 Deceptive Practices
- Use false or misleading header information ("From," "Reply-To," routing)
- Use deceptive, misleading, or clickbait subject lines
- Impersonate any person, business, or entity
- Make false claims about products, services, or capabilities
- Engage in phishing, social engineering, or identity theft
- Misrepresent your relationship with RepHubCRM or any third party
3.4 Illegal Activities
- Promote or facilitate illegal products, services, or activities
- Facilitate fraud, money laundering, or financial crimes
- Distribute malware, viruses, or malicious code
- Violate intellectual property rights (copyright, trademark, patent)
- Violate any federal, state, or local laws or regulations
- Engage in activities that violate export control laws
3.5 Harmful or Objectionable Content
- Harassment, bullying, threats, or intimidation
- Hate speech, discrimination, or content promoting violence
- Adult content, pornography, or sexually explicit material
- Content that exploits, harms, or endangers minors
- Defamatory, libelous, or slanderous content
- Content promoting self-harm or dangerous activities
3.6 System Abuse
- Attempt to gain unauthorized access to our systems, networks, or data
- Interfere with or disrupt the Service or connected networks
- Reverse engineer, decompile, or disassemble any aspect of the Service
- Use automated tools beyond intended functionality (scraping, bots)
- Circumvent rate limits, security features, or access controls
- Share account credentials with unauthorized users
- Resell, sublicense, or redistribute access to the Service
4. CAN-SPAM Compliance Requirements
All emails sent through RepHubCRM must comply with the CAN-SPAM Act. You must:
- Use Accurate Header Information: "From," "To," "Reply-To," and routing information must be accurate and identify the sending business
- Use Truthful Subject Lines: Subject lines must accurately reflect the email content without deception
- Identify as Advertisement: If required, clearly disclose that the message is an advertisement
- Include Physical Address: Every email must contain your valid physical business address (street address, P.O. Box registered with USPS, or registered commercial mail receiving agency)
- Provide Opt-Out Mechanism: Include a clear, conspicuous, and working unsubscribe link
- Honor Opt-Out Requests: Process unsubscribe requests within 10 business days
- Monitor Third Parties: You are responsible for compliance by anyone sending on your behalf
Warning: CAN-SPAM violations can result in penalties up to $51,744 per email. You are solely responsible for compliance.
5. Email Best Practices
To maintain high deliverability and protect our shared sending reputation:
- Only email businesses and business contacts with whom you have a legitimate reason to communicate
- Honor all unsubscribe requests promptly (within 10 business days maximum)
- Maintain bounce rates below 5%
- Maintain spam complaint rates below 0.1%
- Use accurate sender names and reply-to addresses
- Send relevant, valuable content that recipients expect
- Clean your contact lists regularly to remove invalid addresses
- Monitor your email metrics and adjust campaigns accordingly
6. Restricted Industries
We may restrict or prohibit use by certain industries or for certain purposes, including but not limited to:
- Multi-level marketing (MLM) or pyramid schemes
- Get-rich-quick schemes or deceptive money-making programs
- Predatory lending practices
- Cryptocurrency pump-and-dump schemes or fraudulent ICOs
- Adult entertainment or sexually explicit content
- Online gambling (where prohibited by law)
- Counterfeit goods or intellectual property infringement
- Firearms, weapons, or ammunition sales (beyond legal B2B transactions)
- Controlled substances or illegal drugs
- Telemarketing services primarily designed to evade regulations
We reserve the right to refuse service to any industry at our sole discretion.
7. Enforcement
Violations of this Acceptable Use Policy may result in:
- Warning: Written notice requesting immediate compliance
- Temporary Suspension: Suspension of sending capabilities pending review
- Account Termination: Permanent termination of your account without refund
- Legal Action: Reporting to law enforcement or pursuit of legal remedies if required
We reserve the right to investigate suspected violations and take appropriate action without prior notice. Egregious violations may result in immediate termination without warning.
